Foreign Real Estate Ownership in Saudi Arabia: The Full Framework

The Saudi government has released the complete details of the executive regulatory framework governing real estate ownership by foreign individuals, companies and charities in the Kingdom. The framework was approved by the Saudi Real Estate Authority and is designed to reinforce transparency, strengthen oversight, and align with Vision 2030.

My advice to anyone reading it commercially is to start at the compliance end rather than the property end. The conditions below determine whether a transaction is possible at all.

The purpose of the framework

It is designed to enhance transparency in real estate transactions while strengthening regulatory monitoring and reducing associated risks. It also aims to attract foreign direct investment into the property sector, supporting Saudi Arabia’s broader goal of economic diversification under Vision 2030.

Who may own property

The framework allows foreign individuals, including non-residents, as well as foreign companies and institutional investors, to own property in the Kingdom. Ownership is permitted only under clearly defined regulatory conditions, put in place to ensure compliance and market stability.

Requirements for non-resident foreigners

  • Obtain a digital ID approved by the Saudi Ministry of Interior.
  • Ensure the digital ID is linked to an active Saudi mobile number.
  • Open a bank account in Saudi Arabia under the buyer’s name.

Financial and legal compliance

  • All transactions must be conducted through official banking channels.
  • Property dealings must be linked to verified legal and financial records.
  • These measures are aligned with anti-money laundering regulations.

Requirements for companies based outside Saudi Arabia

Not only individuals. Companies based outside Saudi Arabia can also purchase land or real estate in the Kingdom, provided they meet specific criteria:

  • They must be registered with the relevant authorities in their country of origin.
  • They must obtain authorisation from the Saudi Ministry of Investment (MISA) or the relevant regulatory body.
  • They must appoint a legal representative in Saudi Arabia to manage real estate transactions and compliance.
  • All financial transactions must be conducted through a Saudi-based bank account opened in the company’s name.

Of those four, the appointment of a legal representative is the one to begin earliest. It carries a lead time that does not fit inside a closing window.

Requirements for foreign charities and non-profits

Foreign charities and non-profit organisations are also eligible to own real estate in Saudi Arabia under certain conditions:

  • They must be officially recognised and registered in their country of origin.
  • They must obtain prior approval from the Saudi Ministry of Human Resources and Social Development or the relevant authority.
  • Their ownership must be directly linked to their charitable or social activities in the Kingdom.
  • They must comply with all financial and legal reporting requirements, including anti-money laundering regulations.

What the rules are meant to achieve

These rules improve accountability and traceability in property transactions, ensure secure and regulated financial flows, and reduce fraudulent or unverified investments. In turn they build investor confidence in the Saudi real estate market and contribute to a more transparent, well-regulated environment for all stakeholders, foreign companies and charities included.

The framework encourages global investment in Saudi real estate and positions the Kingdom as a competitive property investment destination. By setting clear, enforceable rules, it promotes sustainable and well-regulated market growth while reinforcing Saudi Arabia’s commitment to Vision 2030 and long-term economic development.

How I would sequence a purchase

Work backwards from the identity and banking requirements. A digital ID approved by the Ministry of Interior, linked to an active Saudi mobile number, and a Saudi bank account in the correct name are the prerequisites that make everything else executable. Property selection is the easy part by comparison.
